Welcome to PatientVR™ India | Terms of Use and Subscription Agreement

1. Introduction
Welcome to PatientVR™ by Mobiddiction (India) Private Limited.
Mobiddiction (India) Private Limited is incorporated under the Companies Act, 2013 (18 of 2013). Corporate Identification Number (CIN): U62013KA2026PTC224478
PatientVR™ is an immersive healthcare and wellbeing platform developed by Mobiddiction Pty Ltd, Sydney, Australia and delivered in India through Mobiddiction (India) Private Limited ("Mobiddiction", "we", "our", or "us").
These Terms of Use and Subscription Agreement ("Terms") govern access to and use of the PatientVR™ platform, including the software application, subscription services, configured headset solutions, enterprise deployments, and related services provided to customers in India.
Mobiddiction Pty Ltd remains the owner of the PatientVR™ technology, intellectual property, software platform, content, and associated assets.
Mobiddiction (India) Private Limited is authorised to provide PatientVR™ services, subscriptions, deployments, and customer support within India.
By purchasing, activating, accessing, or using PatientVR™, the Customer acknowledges that they have read, understood, and agreed to these Terms.
2. About PatientVR™
PatientVR™ is an immersive virtual reality healthcare and wellbeing platform designed to support patient relaxation, engagement, comfort, connection, and wellbeing experiences.
PatientVR™ enables healthcare organisations to provide immersive digital experiences through compatible virtual reality devices.
PatientVR™ is designed to complement healthcare programs and patient wellbeing initiatives.
PatientVR™ is not intended to:
- Diagnose medical conditions
- Provide medical advice
- Replace clinical judgement
- Replace professional healthcare treatment
- Make clinical decisions on behalf of healthcare professionals
Healthcare professionals remain responsible for assessing patient suitability and supervising patient usage.
3. PatientVR™ Enterprise Deployment
For healthcare and enterprise customers, PatientVR™ may be deployed through managed headset solutions.
Enterprise deployments may include:
- Compatible Meta enterprise-enabled headsets
- Device procurement
- Device configuration
- PatientVR™ application installation
- Subscription licence activation
- Online device management capability
- Platform support services
"PatientVR PRO" may be used internally by Mobiddiction to describe enterprise deployment configurations and service packages. PatientVR PRO is not a separate trademark, legal entity, or independent product.
All customer-facing rights and licences relate to the PatientVR™ platform.
4. Subscription Licence
Subject to payment of applicable fees, Mobiddiction grants the Customer a limited, non-exclusive, non-transferable licence to use PatientVR™ during the active subscription period.
The subscription provides access to:
- PatientVR™ application
- Approved immersive experiences
- Software updates
- Platform improvements
- Device management capability where applicable
- Technical support relating to the PatientVR™ platform
The Customer does not receive ownership of:
- Software
- Source code
- Technology
- Content
- Designs
- Intellectual property
The licence is provided only for authorised use within the Customer's organisation.
5. Hardware Supply and Configuration
Where headset kits are supplied by Mobiddiction (India) Private Limited, the hardware solution may include:
- Procurement of compatible VR hardware
- Meta enterprise enablement
- PatientVR™ installation
- Subscription activation
- Device configuration
- Testing prior to dispatch
Each headset is configured and tested before delivery.
The Customer acknowledges that the solution consists of:
- Third-party hardware supplied by manufacturers such as Meta; and
- PatientVR™ software services supplied by Mobiddiction.
6. Hardware Ownership and Responsibility
Upon delivery and successful activation, responsibility for the physical hardware transfers to the Customer.
The Customer is responsible for:
- Safe storage of devices
- Charging and battery management
- Physical handling
- Cleaning and hygiene procedures
- Device security
- Appropriate patient supervision
- Following manufacturer operating instructions
Mobiddiction is not responsible for:
- Accidental damage
- Physical damage
- Loss or theft
- Misuse
- Improper storage
- Unauthorised modifications
- Damage caused after delivery
7. Meta Platform Disclaimer
PatientVR™ may operate on Meta Quest and Meta enterprise-enabled devices.
Meta hardware, operating systems, software updates, and related services are provided by Meta Platforms, Inc. and remain subject to Meta's own terms and policies.
Mobiddiction does not control:
- Meta hardware availability
- Meta operating system updates
- Manufacturer changes
- Third-party platform availability
- Meta service interruptions
Hardware-related matters remain subject to applicable manufacturer warranty processes.
8. Payment Terms
Due to the requirement to procure, configure, licence, and prepare headset kits before deployment:
- Hardware and initial deployment fees are payable 100% in advance unless otherwise agreed in writing.
- Subscription fees commence from activation of the PatientVR™ licence.
- Each deployed headset requires an active subscription licence.
The Customer will receive access to the applicable online management platform for ongoing administration of subscribed devices.
9. Delivery and Acceptance
Delivery timelines will be confirmed at the time of order.
Delivery may be impacted by:
- Hardware availability
- Supplier lead times
- Import requirements
- Logistics providers
- Customer delivery requirements
Mobiddiction (India) Private Limited will complete configuration and testing prior to dispatch.
Acceptance occurs when:
- The equipment has been delivered to the nominated location; and
- PatientVR™ has been successfully activated.
Any minor configuration adjustments after deployment do not constitute failure of delivery.
10. Warranty
PatientVR™ software is provided as a subscription service.
The subscription includes:
- Software updates
- Platform improvements
- Technical assistance
Hardware warranty is provided by the original equipment manufacturer.
Mobiddiction is not the manufacturer of third-party hardware and does not provide hardware warranty beyond applicable supplier obligations.
11. Support Services
Mobiddiction (India) Private Limited provides support for the PatientVR™ software platform during the active subscription period.
Support includes:
- Application access issues
- Software configuration assistance
- Platform-related troubleshooting
- Software updates
Support does not include:
- Physical hardware repairs
- Hardware replacement due to customer damage
- Device cleaning
- Local IT support
- Network troubleshooting
- Internet connectivity issues
- Third-party hardware faults
12. Implementation and Local Support
Unless separately agreed in writing:
- Mobiddiction does not provide onsite installation services.
- Mobiddiction does not provide physical maintenance services.
- Mobiddiction does not provide replacement logistics for damaged devices.
Additional onsite services may be separately quoted and agreed.
13. Healthcare Use and Patient Responsibility
PatientVR™ is a wellbeing and immersive experience platform.
The Customer is responsible for:
- Determining patient suitability
- Obtaining appropriate consent where required
- Supervising patient usage
- Following healthcare policies and procedures
Mobiddiction does not provide medical advice or clinical decisions.
14. Patient Safety
Virtual reality experiences may cause discomfort for some users.
Customers should ensure users:
- Follow recommended usage durations
- Take appropriate breaks
- Stop usage if discomfort occurs
- Follow headset manufacturer safety instructions
The Customer remains responsible for safe deployment within its healthcare environment.
15. Privacy and Data Protection
PatientVR™ is designed with privacy and security principles in mind.
Unless separately agreed:
- PatientVR™ does not collect or store patient-identifiable health information.
- Patient information is not required for normal operation.
- Mobiddiction does not act as a healthcare provider.
The Customer remains responsible for ensuring compliance with applicable privacy obligations, including the Digital Personal Data Protection Act, 2023 (DPDP Act), where applicable.
16. Data Security
Mobiddiction applies reasonable technical and organisational measures designed to protect the security of the PatientVR™ platform.
The Customer remains responsible for:
- User access management
- Account security
- Internal policies
- Physical security of devices after delivery
17. Customer Responsibilities
The Customer agrees to:
- Use PatientVR™ responsibly
- Train relevant staff
- Maintain device security
- Protect account credentials
- Follow applicable laws and healthcare requirements
The Customer must not:
- Copy or reproduce PatientVR™
- Reverse engineer the platform
- Modify the software
- Remove security controls
- Allow unauthorised access
- Resell or sublicense PatientVR™
18. Performance Commitment
Mobiddiction will use reasonable commercial efforts to provide PatientVR™ in accordance with agreed specifications.
Performance commitments apply only to the PatientVR™ software platform.
Mobiddiction is not responsible for failures caused by:
- Hardware faults
- Meta platform changes
- Internet connectivity
- Customer systems
- Third-party services
- Events outside reasonable control
19. Defects and Service Issues
Software-related defects reported during an active subscription will be investigated and managed through Mobiddiction support processes.
Hardware defects remain subject to manufacturer warranty processes.
The Customer must provide reasonable information required to investigate reported issues.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Mobiddiction (India) Private Limited and Mobiddiction Pty Ltd are not responsible for:
- Patient outcomes
- Clinical decisions
- Incorrect use of PatientVR™
- Hardware misuse
- Third-party failures
- Indirect or consequential losses
Mobiddiction's maximum liability is limited to fees paid by the Customer for the applicable subscription period.
21. Indemnity
The Customer agrees to indemnify Mobiddiction against claims arising from:
- Improper use of PatientVR™
- Breach of these Terms
- Failure to comply with applicable laws
- Unauthorised access or misuse
22. Subscription Term and Renewal
Subscriptions remain active for the agreed subscription period.
Renewal is subject to:
- Continued agreement between the parties
- Payment of applicable subscription fees
23. Suspension and Termination
Mobiddiction may suspend access where:
- Subscription payments are overdue
- PatientVR™ is misused
- These Terms are materially breached
Upon termination:
- Access to PatientVR™ will cease
- Outstanding payments remain payable
- Customer must discontinue use of the platform
24. Confidentiality
Both parties agree to protect confidential information received during the relationship and use such information only for purposes related to PatientVR™.
25. Governing Law
These Terms are governed by the laws applicable in India.
Any disputes will be subject to the jurisdiction of the applicable courts in India.
